Appealing the medical disability degree

You may appeal the doctor’s decision before a Medical Board for appeals if a medical disability of less than 80% has been determined for you.

The appeal must be sent in writing, with an explanation attached, to the National Insurance branch closest to your place of residence, within 60 days from the date on which you received written notice of the decision. Your appeal will be examined by a Medical Appeals Board made up of two or three doctors.

Appealing incapacity degree

You may appeal the incapacity degree determined for you, if it did not exceeding 74%, or the decision according to which that you did not lose your earning capacity.

The appeal must be sent in writing, with an explanation attached, to the National Insurance branch closest to your place of residence, within 60 days from the date on which you received written notice of the decision.

Your appeal will be examined by a Disability Board (appeals) made up of two or three experts in the fields of occupation, rehabilitation and medicine.

Please note, if the Medical Appeals Board considers lowering your disability degree, it will inform you of its intention, and may in certain cases cancel the appeal.

Appeals Boards only take place in some of the local NII branches, therefore you might be summoned to a board in another city.

The decision by the Appeals Board is final, and may be contested only in matters of law before a regional labor court. The appeal must be submitted to the court in writing within 60 days of the date of receiving notice of the Board’s decision.
