Benefits after the death of a disabled person


The family members of a deceased disabled hostile-action victim who was entitled to benefits at the time of his death may continue to receive the disabled person's benefit for 3 years after his death, provided that he did not die as a result of  the hostilities-related injury and the family members are not receiving benefits under the Families of Fallen Soldiers Law.

The benefit to which the disabled person was entitled at the time of his death is paid for 3 years to the family member specified by the disabled person in writing to the claims officer. If there is no written instruction, the benefit is paid to the spouse and, if there is no spouse, to another family member (as defined in the Invalids Law) as decided by the claims officer. If the disabled person received payment for special needs, this supplement is also paid to the family member.

Benefits after the death of an indigent disabled hostile-action victim 

The spouse of an indigent disabled person is paid benefits for three 3 years after the death at the rate paid to a widower without children under the Families of Fallen Soldiers Law, provided that the spouse does not have enough income for sustenance, and provided that he or she has not remarried.

If the indigent disabled person was not married at the time of his death, but left behind a child, or his spouse died and left behind a child, for 3 years after the death of the disabled person the child is paid the same benefits paid to an orphan under the Families of Fallen Soldiers Law, as long as he is an orphan as defined by the law.

Benefits after the death of a severely disabled hostile-action victim

If the disabled hostile-action victim had a special 100% degree of disability at the time of his death, or his degree of disability was 90% or more due to a head injury of the type determined in the regulations for this matter, and he received a benefit for an indigent disabled person, he is deemed to have been a disabled person who died of his hostile-action injury and his family is entitled to benefits under the Families of Fallen Soldiers Law.

Payment of the benefit balances of a disabled hostile-action victim who dies

If a disabled person had a credit balance of benefits at the time of his death, the balance is paid to the person specified by the disabled person in writing to the claims officer. If there is no written instruction, it is paid to the spouse, and if there is no spouse, it is paid to the heirs.
