If you are entitled, due to the same event, to receive a compensation or a grant from the Ministry of Defense and a disability pension from the National Insurance Institute, you must choose between one of them.
It is important to note that you may receive both, if it is established that your rights did not arise as a result of the same event. For instance, a person injured during his military service and entitled to a compensation from the Ministry of Defense, would be eligible for a disability pension from the NII due to medical impairments that were not caused by the same event.
The above principles apply to all persons entitled to a benefit from the Ministry of Defense by virtue of one of the following laws:
- Invalids Law
- Police Law
- Benefits for Victims of Hostilities Law
- Prison Service Law
- Soldiers’ Compensation Law
- Civil Service Law (Sections 63(7) and 63(8) ).
